Information Collection

Herb-X is the sole owner of the information collected from www.herb-x.com.

Customer Orders

We request information from the user on our order form. A user must provide contact information such as name, email, and shipping address and financial information such as credit card number and expiration date. This information is used for billing purposes and to fill customers' orders. If we have trouble processing an order, the information is used to contact the user.

For processing of payments, Herb-X uses the services of American Express, Discover, MasterCard, Visa and PayPal. Each of these parties maintain their own guidelines for collecting and managing customer profile information.  To view your credit card merchant's privacy policies and statements, refer to the contact information on the reverse side of your card.

Customer Service

We communicate with users on a regular basis to provide requested services and in regards to issues relating to their account. We reply via email or phone, in accordance with our client's wishes.

Though we make every effort to preserve user privacy, we may need to disclose personal information when required by law wherein we have a good-faith belief that such action is necessary to comply with a current judicial proceeding, a court order, or a legal process served on our web site.

Security

Herb-X takes every precaution to protect our users' information. When users submit sensitive information via the web site, their information is protected both on- and off- line.

When our order form asks users to enter sensitive information such as credit card number, that information is encrypted and is protected with the best encryption software in the industry - SSL. While on a secure page, such as our order form, the icon on the bottom right of Web browsers such as Safari, Netscape Navigator and Microsoft Internet Explorer becomes locked, as opposed to un-locked or open, when users are just 'surfing'.

While we use SSL encryption to protect sensitive information on-line, we also do everything in our power to protect user-information off-line. All of our users' information, not just the sensitive information mentioned above, is restricted within our offices. Only employees who need the information to perform a specific job, for example, our customer service representatives, are granted access to personally identifiable information.

If we decide to change our privacy policy, we will post those changes to this privacy statement, the homepage, and other places we deem appropriate so our users are always aware of what information we collect, how we use it, and under what circumstances, if any, we disclose it. Sales Policies

All prices are quoted in U.S. currency. Merchandise, product specifications, availability, imagery and prices depicted are subject to change without notice. Prices in effect at the time of order placement will apply.

Herb-X works hard to ensure that every item we offer is in stock and available for immediate shipment. Most orders ship within 24 hours of being placed - In the rare event that an ordered item remains unavailable to ship after 72 hours have elapsed, Herb-X will inform clients via the email address entered on the checkout page order form.

Items which specify an Expected Ship Date (typically pre-order and backordered items) are date listed as accurately as possible. 

Herb-X respects your privacy and is dedicated to security - all client data is encrypted using strong RC4 128-bit SSL security - countries which do not support 128-bit encryption will fall back to the highest level supported by that country.

In an effort to minimize fraud, Herb-X may contact clients to verify identity. In certain instances, we may ask clients to provide proof of identity and/or proof that a credit card used for payment is in the purchaser's possession.

Delivery

Any shipping dates or times provided are approximate. Conditions may arise which prevent compliance of delivery schedules, Herb-X shall not be liable for any damage or penalty for delay in delivery or the failure to give notice of the delay. Herb-X shall not be liable for delay by reason of inability, due to causes beyond its reasonable control, to obtain the necessary labor, materials, or manufacturing facilities, or for delay due to the elements, acts of God, acts of the Purchaser, acts of nonperformance of suppliers, acts of civil or military authorities, fires, floods, epidemics, quarantine restrictions, war, riot, strikes, accidents due to machinery, delays in transportation, or any other causes beyond the control of Herb-X whether or not similar to the foregoing. In such event, delivery dates shall be deemed extended for a period equal to such delay. The purchaser is responsible for all costs related to incorrectly addressed order submissions.

Refunds, exchanges, defects and cancellations

Incorrectly delivered items will be replaced by Herb-X, including all shipping fees, if reported within 15 days of receipt. Items must be returned in same condition as received with all product packaging intact - returns missing packaging will be subject to a nominal repackaging fee.

Exchanges for client mis-ordered or for color changes are allowed for most items if reported within 15 days of receipt, and received within 30 days. And only if item and package are in new condition - reshipping fees will apply. Client must contact Herb-X to arrange payment for shipping exchanged item(s). Client damaged or altered returns are not refundable or exchangeable - items received by Herb-X damaged or altered will result in the client being notified, and given the option to purchase shipping to have the item(s) returned to them. Item(s) must be returned in like new condition with all components and packaging intact and undamaged. Pack returns well to avoid damage in transit - items and packaging damaged in transit are not eligible for credit.

Defective items: If you believe an item you've received is defective, please phone or email

Once the item has been confirmed defective, and all components are accounted for, the replacement item(s) will be shipped. If the item is being returned for credit, the credit will not be issued until the item has been inspected, tested and confirmed to be defective. Returned items which are found to be free of defects, will result in the client being contacted with options for disposition.

To return an item which you simply do not want, but is otherwise free of defects: Allowed within 15 days of receipt for refund or exchange. Item(s) must be returned in like new condition with all components and packaging intact and undamaged. Pack returns well to avoid damage in transit - items and packaging damaged in transit are not eligible for full credit. If product packaging is not returned, but the returned item is otherwise in like new condition, an item-specific re-packaging fee will apply.

Canceling an order

If the order has already shipped, simply return the merchandise to the Herb-X mailing address listed above once received. Include a brief note detailing the reason for return, and whether a refund or exchange is desired. Include the name and/or order ID from the original invoice. Please insure, or require delivery confirmation on your return to avoid any issues. Product refunds will be issued via credit to the card used, or via a mailed refund check if purchase was made using PayPal. All credits will be transacted within 48 hours of receipt of returned goods. Shipping fees are not refundable.

Returning product to Herb-X

Only products purchased directly from Herb-X can be returned to Herb-X - unless defective and returning for warranty exchange. Return product and all components, postage paid, and in original packaging, to the Herb-X mailing address listed above. Include a brief note detailing the reason for return, and whether a refund or exchange is desired. Include the "ship to" name and/or order ID from the original invoice for proper credit - items returned without adequate ID are impossible to process and will be held for 30 days. Items remaining unclaimed after 30 days will be donated to a charitable organization of Herb-X's choosing. Please insure, or require delivery confirmation on your return to avoid any issues. Product refunds will be issued via credit to the payment vehicle used. All credits will be transacted within 48 hours of receipt of returned goods. Shipping charges are not refundable. Item(s) must be returned in like new condition with all components and packaging intact and undamaged. Pack returns well to avoid damage in transit, insurance is strongly recommended - items and packaging damaged in transit are not eligible for credit.
